What you can expect from Options Whale, what we expect from you, and the lines we both agree to hold.

Agreement to these terms
These terms govern your use of Options Whale — the website, the application, and every feature we ship under that name (the “Service”). By creating an account, importing trades, or otherwise using the Service, you agree to these terms. If you do not agree with them, do not use the Service.
You must be at least 18 years old and able to enter into a binding contract where you live to use Options Whale. The Service is for individuals tracking their own trading; if you use it on behalf of a firm or another person, you confirm you have the authority to bind them to these terms.
What Options Whale is — and is not
Options Whale is a trade journal and performance analytics tool. You bring your trade history — through a broker connection or a file import — and the Service organises it, measures it, and shows it back to you: what you traded, how it worked out, and where your results come from.
To be completely clear about what that does not make us:
- We are not a broker or dealer. We do not hold your money or securities, execute orders, or route trades anywhere. Your broker does all of that, under your broker’s own terms.
- We provide no financial, investment, tax, or legal advice, and no recommendations about any security, strategy, or trade. Every number the Service shows is a measurement of your own past data, not a suggestion about what to do next.
- The Service does not place trades and cannot move money. Broker connections are read-only: they pull statements and fills in, and nothing goes back out to your broker.
Trading decisions are yours alone, and so are their consequences. If you want advice tailored to your situation, talk to a licensed professional.
Your account
When you create an account you must give us accurate, complete, and current information — an email and a password at signup. Keep your credentials to yourself: everything that happens under your account is treated as your doing. Tell us at support@options-whale.com as soon as you suspect anyone else has access.
You are responsible for the activity in your account, including any trade data, notes, and screenshots you add to it. We may suspend or close accounts that break these terms, impersonate someone else, or use the Service in a way that could harm it or other users.
Using the Service
You agree not to:
- upload or connect data you have no right to use, or data about someone else’s trading without their permission;
- probe, scan, overload, or circumvent any security or rate limit of the Service, or try to access parts of it you were not given;
- reverse engineer, resell, or white-label the Service, or build a competing product from its output, except where the law forbids us to stop you;
- use automated access (scrapers, scripts, unofficial API calls) without our written permission;
- use the Service for anything unlawful, or to misrepresent your trading record to anyone.
We may set and enforce reasonable limits (such as account counts, import volume, or message quotas) on any plan. The limits of each plan are described on the pricing page and in Settings.
Your data
Your trade data, notes, tags, screenshots, and everything else you put into Options Whale remain yours. We do not own them, sell them, or use them to advertise anything.
To actually run the Service you grant us a licence to host, process, copy, and display that data — for example to calculate your analytics, render your charts, back it up, and support you when you write in. That licence exists only for the purpose of operating and improving the Service for you, and it ends when your data is deleted.
You can export your trades as CSV and delete your account — along with its data — from Settings at any time. Deletion is permanent; see the privacy policy for the detail on what lingers in backups and for how long.
Plans, trials, and billing
Options Whale offers paid subscription plans and a free trial. The trial runs for 7 days, needs no payment card, and therefore cannot silently turn into a charge — nothing starts billing until you choose a plan yourself. We may change plan prices or what each plan includes. If a change affects a plan you are on, we will give you reasonable notice before your next renewal, and you can cancel before it takes effect.
No advice, no recommendations
Nothing in the Service is a recommendation to buy, sell, or hold any security, or to adopt or abandon any strategy. Analytics, scores, insights, simulations, and any other output are informational and educational measurements of historical data — nothing more. They do not account for your financial situation, tax position, or risk tolerance, and they are not a substitute for professional advice.
Simulated and hypothetical results
Some parts of the Service — the replay tools, simulators, and anything labelled simulated — generate hypothetical results. These have inherent limitations, and you should know them before relying on any of it:
- hypothetical results are prepared with the benefit of hindsight and do not involve real financial risk;
- no representation is made that any account will or is likely to achieve profits or losses similar to what a simulation shows;
- real trading is affected by things a simulation cannot reproduce — liquidity, slippage, latency, emotion, and the ability to stick to a plan under pressure.
Past performance of any account, real or simulated, is not indicative of future results.
Market data and third-party services
Trade data reaches Options Whale from third parties: your broker (currently Interactive Brokers Flex statements), files you import, and market data sources behind features like screeners and quotes. We do not produce that data and cannot guarantee it is complete, accurate, or timely. Prices and analytics may be delayed, may contain errors, and are not fit for order entry or valuation. When something looks wrong, the source — not the Service — is the authority.
Broker connections are made with credentials you create (for IBKR, a Flex Web Service token and query ID — we never see your broker password). Their use is also governed by the third party’s own terms. We are not responsible for outages, changes, or data problems originating with them.
Intellectual property
The Service itself — software, design, charts, text, and the Options Whale name and logo — is ours, protected by copyright, trademark, and other laws. These terms give you a personal, non-exclusive, revocable licence to use the Service; they do not transfer any ownership to you.
If you send us feedback or suggestions, we may use them freely — with no obligation or credit — because that is how the product gets better.
Ending your use
You can stop using Options Whale and delete your account at any time from Settings. We may suspend or terminate access — with notice where we reasonably can — if you breach these terms, if the Service is being abused, or if we are required to by law. If we shut the Service down entirely, we will give reasonable notice and a way to export your data.
Clauses that by their nature should survive termination — ownership, disclaimers, liability limits, indemnity — survive it.
Disclaimers and limitation of liability
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied — including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any analysis derived from it will meet your requirements.
To the maximum extent the law allows, Options Whale and its people are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or trading losses, arising from your use of — or inability to use — the Service, whether based on warranty, contract, tort, or any other theory, even if we were warned such damage was possible.
Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose. Some jurisdictions do not allow certain exclusions; in those places, our liability is limited to the fullest extent permitted.
Indemnity
You agree to hold harmless and indemnify Options Whale and its people against claims, losses, and expenses (including reasonable legal fees) arising from your trading decisions, your use of the Service, data you submitted, or your breach of these terms.
Changes to these terms
We may update these terms as the product evolves. If a change is material, we will give reasonable notice — by email or a notice in the app — before it takes effect. Continuing to use the Service after a change means you accept it; if you do not, stop using the Service and delete your account.
Governing law and contact
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. If one clause is held unenforceable, the rest remain in effect.
